This Administrative Code filing moves language from Part 102 Rules 7.10-7.13 adding a new rule 1.8 outlining the process of recovery from a Medicaid recipient’s estate.

This Administrative Code is being filed to remove all outdated references to families, children and CHIP (FCC) programs to modified adjusted gross income (MAGI); to update all regulatory citations, and to remove all examples. Also, to move Rules 7.10-7.13 to Part 306.

Pursuant to the special called meeting of the Mississippi Board of Nursing Board of Directors on April 29th, 2020 , the Board voted to continue to fulfill its legislative mandate to protect the public and conduct informal and formal disciplinary proceedings virtually during the COVID-19 pandemic. The Board adopts the temporary rule herein, pursuant to authority granted in Miss. Code Ann. § 25-43-3.108 (1972, as amended) and Miss. Exec. Order 1471 (Apr. 10, 2020), in an effort to ensure public safety and prevent the spread of COVID-19.

To revise Mississippi Nonpublic School Accountability Standards, 2020, specifically Process Standard 22 and Appendices A and B.

This rule defines DMH Certification processes for agencies seeking certification as community service providers. This rule has been placed into Title 24, Part 2 Operational Standards for Mental Health, Intellectual/Developmental Disabilities, and Substance Use Community Service Providers and needs to be repealed.

Temporary Rule Part 2826 establishes the framework and processes for implementation of a confidential and non-disciplinary program for eligible nurse applicants designed to promote early identification of substance use/abuse; removal from nursing practice and entry into treatment; and for monitoring of compliance upon re-entry into nursing practice.

Due to issues related to the COVID-19 emergency and the impact the spread of the disease has had on the meat supply chain, the Department issues this temporary rule in an effort to increase meat availability to consumers. The temporary rule will increase the number of people that can own an animal (cattle, sheep, swine, and goats) from four to multiple owners for the purposes of the custom slaughter exemption of the meat inspection laws. The regulation will be effective for 120 days from May 7, 2020 through September 3, 2020.
