Pursuant to Miss. Code Ann. § 49-17-29 (2), a permit or permit exemption is required for “any person to cause pollution of any waters of the state or to place or cause to be placed any wastes in a location where they are likely to cause pollution of any waters of the state.” Pursuant to 11 Miss. Admin. Code Pt. 6, Ch.1, R. 1.1.1.B.1, the submission of an application is required for any proposed discharge to waters of the State. This regulation is proposed to clarify the definition of waters of the State and enhance regulatory certainty by introducing less burdensome alternatives to permitting – exemptions and conditional exemptions – for certain activities that affect waters of the State exclusively

1. Modification to reportable disease rules and regulations to require reporting of all positive and negative Hepatitis C RNA results as a Class 3 reportable result. This modification will allow for improved surveillance of acute and chronic Hepatitis C including the ability to identify cases that are resolved with treatment. 2. Modification to reportable disease rules and regulations to require reporting of Respiratory Syncytial Virus (RSV)-associated pediatric mortality (<18 years of age) as a Class 1B reportable report. This modification will allow for improved surveillance of the pediatric age group who are adversely affected by RSV infections. 3. Modification to reportable disease rules and regulations to require reporting of all positive Anaplasmosis results as a Class 2 reportable result. This modification will allow for improved explicit surveillance of this tickborne disease. The Blacklegged Tick, which transmits Anaplasmosis, has been identified in Mississippi. 4. Modification to reportable disease rules and regulations to reclassify the following Class 1A diseases and conditions to a Class 1B designation to alleviate reporting burdens: Congenital Zika virus infection including Congenital Zika Syndrome, Brucellosis, Diphtheria, Influenza-Associated Pediatric Mortality (<18 years of age), Melioidosis, Psittacosis, Q Fever, SARS-CoV-2 Associated Mortality in Pregnancy, SARS-CoV-2 Associated Pediatric Mortality (<18 years of age), Tularemia. 5.
