Failure to render reasonably adequate service

For purposes of Sections 41-26-201 through 41-26-211 and Sections 49-17-801 through 49-17-811, notwithstanding any provisions to the contrary in Chapter 3 to Title 77 of the Mississippi Code, during any period a Community Public Water System or Community Public Wastewater System is assigned a letter grade of “D” or “F”, any such system shall be considered grossly inefficient, irresponsible and unresponsive to the needs of its customers such that it will be deemed to be failing to render reasonably adequate service and from that point forward shall be subject to the authority and jurisdiction of the Mississippi Public Service Commission for the sole purpose of exercising any rights afforded said commission under Sections 77-3-21 and 77-3-22.
