(1) Upon reaching seventy-five percent (75%) of a system’s total capacity, providers shall make plans to upgrade their utility to increase its capacity design.
(2) Upon commencement of places to upgrade a utility, providers shall also update an asset management plan to prepare such utilities for future economic growth.
(3) Any provider which fails to meet the requirements of this subsection is subject to a statement of deficiency issued by the Mississippi State Department of Health.
