(1) A person who intentionally makes a false statement, misrepresentation, or false certification in a record filed or required to be maintained under this chapter or that intentionally makes a false entry or omits a material entry in such a record is guilty of a felony and, upon conviction thereof, shall be fined no less than Five Hundred Dollars ($500.00) nor more than Three Thousand Dollars ($3,000.00), and may also be punished by imprisonment in the custody of the Department of Corrections for a term not less than one (1) year and not more than five (5) years.
(2) A person that knowingly engages in an activity for which a license is required under this chapter without being licensed under this chapter and who receives more than Five Hundred Dollars ($500.00) in compensation within a thirty-day period from this activity is guilty of a felony and, upon conviction thereof, shall be fined no less than Five Hundred Dollars ($500.00) nor more than Three Thousand Dollars ($3,000.00), and may also be punished by imprisonment in the custody of the Department of Corrections for a term not less than one (1) year and not more than five (5) years.
(3) A person that knowingly engages in an activity for which a license is required under this chapter without being licensed under this chapter and who receives no more than Five Hundred Dollars ($500.00) in compensation within a thirty-day period from this activity is guilty of a misdemeanor and, upon conviction, shall be fined not less than One Hundred Dollars ($100.00) nor more than Five Hundred Dollars ($500.00), and may also be confined to the county jail for not more than twelve (12) months.
