§ 11111. Penalties. (a) Upon prosecution by the Office of the Attorney General, any person who is found guilty of: (1) Knowingly misapplies any monies or funds belonging to the Rota Municipal Scholarship Foundation; or (2) Agrees to or is instrumental in the award of funds to any individual on any basis other than as merit and need as determined by the Board in accordance with this Act or regulations issued hereunder; or (3) Willfully makes any false entry in the books of the Board; (4) Willfully makes a material misrepresentation on an application to the Board for financial assistance; or (5) Violates any provisions of this Act, regulations, or any term or condition pertaining to an award of financial assistance award, shall be barred from employment or re-employment within the First Senatorial District for a period of not less than five years from the date of the conviction. (b) The penalty provided in this section is in addition to any penalties that may be incurred for a violation of the Commonwealth Code. (c) In addition to the penalties provided by subsection (a) and (b) of this Section, any person who is found guilty of violating any of the provisions of subsection (a) of this section shall be civilly liable for the repayment of any fund misapplied or expended or encumbered without authority of the Board, and for repayment of all assistance granted to a recipient, together with interest thereon of five percent from the date thereof.
