§ 1153. Exceptions to Sections 1151 & 1152. (a) Exceptions to the requirement of immunizations and physical examination shall be granted by the Commonwealth Healthcare Corporation’s Division of Public Health Services pursuant to policies established by its Director. Said policies shall include exemptions from § 1151 for children who have a physician's statement that the child may be exempt from any or all of the required immunizations of subsection (a) of this section. (b) If a child has medical contraindications to the immunization program pursuant to subsection (a) of this section, and there is good cause to believe that the child has been exposed or will be exposed to one of the communicable diseases against which the program is designed to provide immunity, the Commissioner may temporarily exclude the child from school until a physician certifies that the child’s health is no longer at significant risk. (c) Notwithstanding any other provisions of this Article, whenever there is good reason to believe that any student is suffering from or is a carrier of any dangerous contagious disease, the Commissioner may temporarily exclude the child from school until a physician certifies that there is no longer any significant risk of contagion. The Commission corrected the title to read “Exceptions to Sections 1151 & 1152” pursuant to 1 CMC § 3806(g). The Commission changed “Section 1161” to “§ 1151” in (a) pursuant to 1 CMC § 3806(d) and (g).
