§ 12116. Majority of Commission Members Required for Action. (a) A majority decision of the five Commissioners being present shall determine any action of the Rota Casino Gaming Commission, provided however, that no casino or interim casino authorization may be issued without the approval of four members, with the exception of 10 CMC § 12113(b) Mayor's removal for cause provision which requires a duly constituted quorum, following the applicable provisions of the CNMI Open Government Act [1 CMC §§ 9901-9918]. (b) In the event that a vacancy has existed in the Commission for more than 30 days, a majority of the full Commission, not less than four members may act with respect to any matter, including the issuance of a casino license or interim casino authorization.
