§ 2077. Commonwealth Health Plan: Action by Governor. (a) The Commonwealth health plan, or any revised Commonwealth health plan approved by the council, shall be the official health plan for the Commonwealth upon its approval by the Governor. The plan may be disapproved by the Governor only if the Governor determines that it does not effectively meet the health needs of the Commonwealth. In disapproving the Commonwealth health plan the Governor shall make public a detailed statement of the basis for the determination that the plan does not meet those needs and shall specify the changes in the plan which the Governor determines are needed to meet those needs. (b) The Commonwealth health plan shall take effect without the approval of the Governor if the Governor does not disapprove it within 60 days after he receives it from the council.
