§ 2186. Assumption of Functions by Authority. On the date the authority assumes its functions under this act, the board of directors or the executive director, as the case may be, shall immediately commence to employ necessary personnel for the operation of the authority and its ports, or contract for the necessary service. Employees working for the ports in the Commonwealth shall continue to be employed by the agency employing them on the date of the assumption of functions by the authority. The board of directors may either: (a) Continue to utilize the services of those employees by arrangement with the department which employs those persons, in which case the employees shall retain their status and the pay within the departments employing them, and payment for their services shall be arranged by agreement between the authority and the department or agency head employing the persons; or (b) The board of directors may, with the agreement of the employees involved, employ the persons as employees of the authority pursuant to the powers granted to the board and to the executive director by this chapter. In such event, the employees, upon being employed by the authority, shall no longer be employees of the government nor shall the Commonwealth Civil Service Act [1 CMC § 8101 et seq.] apply to said employees, nor to any other employees of the authority.
