§ 2210. Penalties. (a) Any person who (1) Willfully misapplies any monies or funds belonging to the Municipal Scholarship Board, or (2) Agrees to or does not award funds to any individual on any basis other than merit and need, as determined by the board in accordance with regulations and guidelines issued or (3) Willfully makes any false entry in the books of the board, or (4) Violates any provisions of this chapter or (5) Knowingly and willfully falsifies any application for assistance from the scholarship board or who being the recipient of such assistance expends all or part of the same for other than the furthering of his/her education or as prescribed by the board as a condition of such assistance, shall be guilty of a misdemeanor, and upon conviction shall be fined $100 or imprisoned for a term not exceeding 30 days or both. (b) The penalties provided in this section are in addition to any penalties which may be incurred for a violation of the Commonwealth Code. (c) In addition to the penalties provided by subsections (a) and (b) of this section, any person who violates any of the provisions of subsection (a) of this section shall be civilly liable for the repayment of any funds misapplied or expended or encumbered without authority of the board, and for repayment of all assistance granted to a recipient, together with interest thereon at five percent from the date thereof. The municipality of Tinian or Aguiguan may maintain any appropriate legal action in its own name for the recovery of such funds.
