§ 2228. Confidentiality. (a) The Open Government Act of 1992, 1 CMC §§ 9917-18, shall determine the extent to which the Board's records, files and other information shall be privileged and confidential and may be protected from disclosure. Such protection shall apply to the work product of an attorney retained by or for the Board, whether or not an assistant attorney general. (b) Notwithstanding any other provision of law, information secured pursuant to an investigation by the Board, or with respect to a referral by the Board for prosecution, including the name of a complainant or witness, shall be confidential and exempt from disclosure, until such investigation or referral has been completed and the matter dismissed or a pleading filed. (c) Further protection from disclosure may be provided by the Board, an administrative hearing officer or judge, pursuant to notice and an opportunity to be heard.
