§ 2262. Board of Education: Tenure. (a) Elected members of the board shall serve terms of four years except that the terms of the first members elected shall be determined by drawing of lots with three members serving a term of four years and two members serving a term of two years. (b) The student representative enrolled in a public school shall be appointed for a term of one year. (c) Elected members of the board shall serve commencing on the second Monday of January in the year following the regular general election at which they were elected. (d)(1) The Teacher Representative appointed by the Governor shall serve a term of two years. (2) No teacher may be elected Teacher Representative more than twice. (e) The non-public school representative, appointed by the Governor, shall serve a term of two years. Commission Comment: The Commission rearranged the sections of PL 1907 to fit harmoniously within the code pursuant to 1 CMC § 3806(b), and accordingly renumbered the sections pursuant to 1 CMC § 3806(a): PL 19-07 Section 3, subsections “a.” and “c.” were codified at 1 CMC § 2262(c) as subsections (c)(1) and (c)(2) respectively. The Commission capitalized “teacher representative” and “governor” in subsection (c)(1) for the purpose of conformity, pursuant to 1 CMC § 3806(f). In codifying PL 20-23 the Commission omitted drafting marks throughout and removed “who” after “school” in (b) pursuant to 1 CMC § 3806(g).
