§ 2316. Reporting Requirement. (a) Affected Parties. (1) Hospitals, nursing homes and other employers of Registered Nurses, Licensed Practical/Vocational Nurses, Certified Technicians, Certified Nursing Assistants and Advanced Practice Registered Nurses shall report to the Board the names of those licensees whose employment has been terminated voluntarily or involuntarily for any reasons stipulated in section 2314(a) of this chapter. (2) Nursing associations shall report to the Board the names of Registered Nurses, Licensed Practical/Vocational Nurses, Certified Technicians, Certified Nursing Assistants, Advanced Practice Registered Nurses who have been investigated and found to be a threat to the public health, safety and welfare for any of the reasons stipulated in section 2314(b) of this chapter. (b) Court Order. The Board may seek an order from the proper court of competent jurisdiction for a report from any of the parties stipulated in section 2316(a) of this chapter if one is not forthcoming voluntarily. (c) Penalty. The Board may seek a citation for civil contempt if a court order for a report is not obeyed by any of the parties stipulated in section 2316(a) of this chapter. (d) Immunity. Any organization or person reporting, in good faith, information to the Board under this chapter shall be immune from civil action as provided in section 2314(e) of this chapter.
