§ 2321. Mayor’s Appointment of Resident Department Heads: Timely Submission to Municipal Council for Confirmation Required. The mayor’s appointment of resident department heads, pursuant to N.M.I. Const. art. VI, § 3, shall be submitted to the municipal council within five days following the date the person was temporarily appointed. Source: LL 5-4, § 2, modified. Commission Comment: LL 5-4 took effect January 14, 1988. According to LL 5-4, §§ 1 and 4: Section 1. Purpose. The purpose of this local Act is to better organize the Office of the local mayor by requiring that the Mayor’s Appointment of Resident Department Heads be submitted to the Municipal Council in a timely fashion for confirmation. ... Section 4. Repealer. Any Tinian Municipal Ordinance that is inconsistent with the provision of this Act is hereby repealed. The Commission inserted a colon in place of a dash in the heading of 10 CMC § 2321 to conform the heading to the style used elsewhere in the code. According to PL 3-90, § 7(a) (reprinted in the preface material, prior to title 1), “section headings . . . do not in any manner affect the scope, meaning, or intent of the provisions of this Code.”
