§ 2403. Department of Public Works: Duties. The Department of Public Works shall have the following duties and responsibilities: (a) To construct and maintain all public works and roads, unless otherwise provided by law; (b) To construct, maintain, and operate public signs, traffic signals, parking meters, public vessels, public buildings, and public works functions previously performed by chartered municipalities, unless otherwise provided by law. Commission Comment: With respect to the reference to the “Department of Public Works,” see Executive Order 94-3 (effective Aug. 23, 1994), reorganizing the executive branch, changing agency names and official titles, and effecting other changes, set forth in the Commission comment to 1 CMC § 2001; see also the comment to 1 CMC § 2401. PL 18-54 (July 1, 2014) contained, in addition to savings and severability clauses, the following Findings and Purpose sections: Section 1. Findings. This Act may be cited as the “Parking Meter Act.” Section 2. Purpose. The purpose of this Act is to ensure that Department of Public Works and the Commonwealth Office of Transit Authority (COTA) have statutory authority to assess fees associated with parking be deposited according to which senatorial district generated the fees and into separate accounts designated for each senatorial district. The fees collected would be subject to appropriation by the respective legislative delegations. This Act also gives COTA the authority to create regulations so that COTA may effectively use and administer the fees in furtherance of an operational transit system.
