§ 2407. Department of Public Works: Rights of Way. (a) The Department of Public Works is hereby exclusively authorized to promulgate rules and regulations pertaining to rights of way in all senatorial districts. The Department of Public Works shall also establish and enforce a fee schedule as well as civil fines and penalties consistent with the aforementioned rules and regulations in conformance with the CNMI Administrative Procedures Act set forth in 1 CMC § 9101 et seq. (b) The Department of Public Works shall publish all applicable rules and regulations, fines and fees in the CNMI Register or other appropriate publication in conformance with the CNMI Administrative Procedures Act. (c) The Secretary of Finance shall establish an account and business unit within the CNMI General Fund which, in accordance with this section shall be established as a “Program Income” account under the Technical Services Division within the Department of Public Works to utilize as “Rights of Way Maintenance Funds.” (d) All funds collected under this section shall be deposited into the “Program Income” account.
