§ 2416. Bid Procedure; Minimum Bid; Time of Payment; Local Preference. (a) Except for the first year in which this law becomes effective, bids must be submitted on or before 15 days from the expiration of an existing franchise. Each bid shall be sealed and accompanied by a deposit of 20 percent of the total amount of the bid, in the form of cash, postal or express money order, cashier’s check or certified check, or bank draft, payable to a public officer or employee to be designated by regulation of the board. (b) The minimum bid which shall be received or accepted for a franchise license shall be $3,000. Any bid which fails to comply with any of the terms and conditions as provided or by regulation of the board, shall be considered null and void. (c) Payment of the cockfighting license by the successful bidder must be made within 10 days after the opening and award of the franchise license by the board. The method of payment shall be the same as that designated for deposits. (d) All bid deposits of all unsuccessful bidders shall be returned to said bidders. If the successful bidder fails to make full and final payment in the manner and time provided by this chapter, the board reserves the right to award the franchise license to the second or succeeding highest and responsible bidder. Any deposit made by the original successful bidder shall be forfeited and proceeds applied as provided by local revenue law. (e) All bids shall be publicly opened and announced by the board. The hour and place of opening bids shall be stated in the notice of invitation to bid. (f) The board reserves the right, by majority vote, to reject any or all bids for good cause; to make further invitations for bids in the same manner as the original invitation; to waive immaterial irregularities in the bidding process; and to enter into a contract to let the franchise, without further invitation, if no bid is received on the first invitation. (g) In awarding the franchise license, the board shall give preference to United States citizens or lawfully admitted permanent residents, or to firms which are 75 percent owned by U.S. citizens or lawfully admitted permanent residents, except, the bid by such U.S. citizen or lawfully admitted permanent resident must not be less than 20 percent of the bid by those not eligible for this preference.
