TITLE 10: LOCAL LAWS DIVISION 2: SECOND SENATORIAL DISTRICT (TINIAN, ETC.)

§ 25173. Entry to Casino by Members of the Police Force. (a) Any member of the police force may, in the discharge of his duty, enter any area of a casino to which the public has access. (b) Any such area is a public place for the purpose of the exercise by a member of the police force of powers and the discharge by him of duties exercisable or, as the case may be, to be discharged by him in a public place under any act or law. (c) A member of the police force may, on being authorized so to do by an inspector on duty at a casino, enter any other area of the casino in the discharge of his duty, provided that this provision does not limit or prejudice the exercise by a member of the police force of any other power he has pursuant to law to enter a casino or any part of it. (d) When an inspector gives an authorization to a member of the police force in accordance with subsection (c) of this section, he shall, where practicable, give notice of the authorization to the person who is for the time being in charge of the operation of the casino. (e) To the extent that this Section authorizes warrantless searches, the Commission and its employees will act only pursuant to a waiver given by an applicant or licensee.
