Definitions. In this article: (a) “Commonwealth park” means an area set apart and designated as a Commonwealth park by the Division of Parks and Recreation including any public facilities located within the boundaries of the park, and any tourist site formerly managed and maintained by the Marianas Visitors Authority, but excluding the Haruji Matsue Sugar King Park. In addition, the public property in Sadog Tasi, known specifically as Track Number 21077-2 is hereby designated as a Commonwealth park. (b) “Department” means the Department of Lands and Natural Resources. (c) “Director” means the Director of the Division of Parks and Recreation. (d) “Division” means the Division of Parks and Recreation. (e) “Fund” means the Commonwealth Parks and Recreation Fund. (f) “Recreational facility” means all public sports and recreational facilities and outdoor sports and recreational fields and areas except for the Gilbert C. Ada Gymnasium and adjoining sports facilities which shall be under the sole management and control of the Northern Marianas Sports Association, a private nonprofit corporation. (g) “Secretary” means the Secretary of the Department of Lands and Natural Resources. The Commission changed capitalization in subsection (a) pursuant to 1 CMC § 3806(f). The Commission inserted quotation marks around the term “recreational facility” in subsection (f) pursuant to 1 CMC § 3806(g). PL 17-72 (enacted May 14, 2012) included the following: Section 2. Land designation; management and disposition. The management, control, and disposition of a certain public land, specifically TRACT NUMBER 21077-2 located in Sadog Tasi, Saipan, shall be transferred from the Department of Public Lands to the jurisdiction of the Department of Lands and Natural Resources under the Division of Parks and Recreation. The said property is further designated as a Commonwealth Park for the residents and visitors of the island of Saipan.
