§ 2799. Penalties. (a) Any person who violates the provisions of this chapter shall be guilty of a misdemeanor and shall, upon a first conviction, fined not more than $500 and be imprisoned for not more than 90 days. (b) Upon a second or subsequent conviction for a violation of this chapter, a person shall be fined not more than $2000 and imprisoned for not more than one year.
