§ 30201. Prohibition. It shall be unlawful for any commercial or non-commercial fishermen to use SCUBA and other related devices when fishing for reef fish, other types of fish or harvesting other marine life within the lagoon and coastal waters of the island of Saipan and the Northern Islands. Source: Saipan LL13-13, § 2. Commission Comment: SLL 13-13 was enacted on May 9, 2003 and contained a statement of purpose and findings, severability, and savings clause provisions. According to SLL 13-13: Section 1. Statement of Purpose and Findings. The Third Senatorial District Delegation finds that the use of self-contained underwater breathing apparatus (SCUBA) and other related diving devices by commercial and non-commercial fishermen have caused a significant depletion of reef fish, other types of fish or other marine life within the lagoon and coastal waters of the municipality of Saipan and the Northern Islands. Furthermore, the need to preserve and regulate the fishing and harvesting of marine life in this area is essential to maintaining, preserving, and enhancing our marine ecosystem for the use and enjoyment of future generations of the Northern Marianas Island residents. Thus, the intent of this Act is to prohibit or restrict the use of SCUBA and other related devices by commercial and noncommercial fishermen when fishing for reef fish, other types of fish or harvesting other marine life within the lagoon and coastal waters of the municipality of Saipan and the Northern Islands.
