§ 30202. Penalty. The use of SCUBA and other related diving devices by commercial and noncommercial fishermen when fishing for reef fish, other types of fish or harvesting other marine life within the lagoon or coastal waters of the island of Saipan and the Northern Islands shall be punishable by a fine of not more than $1,000.00 or imprisonment for not more than six months or both. In addition, the SCUBA apparatus (SCUBA tank, SCUBA vest, respirator) and other equipment used in this illegal form of fishing (spear gun, the boat and motor used to transport the fishermen) shall be confiscated and donated to the Division of Fish and Wildlife to assist in their monitoring and enforcement of regulations governing commercial and non-commercial fishing. All fines collected shall be deposited into the Fish and Game Conservation Fund in a special subaccount to support the conservation and enforcement activities within the municipality of Saipan and the Northern Islands only.
