GENERAL PROVISIONS

§ 304. Penalties for Attempt, Solicitation, and Conspiracy. (a) A person convicted of attempt or solicitation shall be punished: (1) If the maximum sentence provided for the offense which was the object of the attempt or solicitation is life imprisonment, by imprisonment for not more than 20 years; (2) Otherwise, by imprisonment for not more than one-half of the maximum penalty provided for the underlying offense which was the object of the attempt or solicitation. (b) A person convicted of conspiracy may be punished by not more than the same penalty provided for the underlying offense. Source: PL 3-71, § 1 (§ 204); amended by PL 3-72, § 2 (§ 204).
