§ 3105. Appellate Examiner: Appointed; Compensation; Duties. The U.S. Commissioner of Social Security shall appoint for a defined term a person to the office of Appellate Examiner. The Appellate Examiner shall hear and make decisions on appeals from final determinations of the Social Security Administrator. The qualifications for appointment to the position of Appellate Examiner as well as his compensation shall be established by the Governor. The Appellate Examiner shall have the power to audit employer records, issue subpoenas, and administer oaths, as appropriate and necessary to his decision on appeals. Source: DL 5-12, § 1. Commission Comment: The Commission inserted a colon and semicolons in place of dashes in the heading of this section to conform the heading to the style used elsewhere in the code. According to PL 3-90, § 7(a) (reprinted in the preface material, prior to title 1), “section headings . . . do not in any manner affect the scope, meaning, or intent of the provisions of this Code.”
