TITLE 6: CRIMES AND CRIMINAL PROCEDURE DIVISION 3 : MISCELLANEOUS OFFENSES

§ 3179. Declaration of Establishment as Non-Smoking. Notwithstanding any other provision of this article, an owner, operator, manager, or other person in control of an establishment, facility, or outdoor area may declare that entire establishment, facility, or outdoor area as a nonsmoking place, including the outdoor area within 25 feet of the entrance or exit to such establishment. Smoking shall be prohibited in any place in which a sign conforming to the requirements of 6 CMC § 3180(a) is posted. Commission Comment: The Commission replaced a public law section reference with the corresponding codified section number pursuant to 1 CMC § 3806(c). In codifying PL 19-82, the Commission renumbered this section from 6 CMC 3178 pursuant to 1 CMC § 3806(a). The Commission changed the reference “6 CMC § 3179(a)” to “6 CMC § 3180(a)” to agree with the renumbered section pursuant to 1 CMC § 3806(c).
