§ 3404. Written Opinions. Decisions of the Supreme Court and of the Superior Court which determine a case and decisions which determine a substantial question of procedure or substantive law shall be set forth in written opinions, with the reasons for the decision stated, within one year of submission of the case for decision, and shall be published in consultation with the Law Revision Commission. On January 15, 2004, the CNMI Supreme Court held that the one year requirement in the above section violated the separation of powers doctrine of article IV, section 1, of the CNMI Constitution and is therefore unenforceable. Reyes v. Reyes, 2004 MP 1 ¶ 103.
