§ 3436. Criminal Penalties. (a) Whenever, by reason of an investigation under section 3431 of this Act or otherwise, the Board has reason to believe that any person or firm has knowingly engaged in acts or practices that constitute a violation of section 3434 of this Act, the Board may bring its information to the attention of the Attorney General of the CNMI (or other appropriate law enforcement officer) who may, in the officer’s discretion, cause appropriate criminal proceedings to be brought thereon. (b) Any person or firm who knowingly violates any provision of section 3434 of this Act shall be guilty of a misdemeanor, and upon conviction thereof shall be subject to a fine of not more than $10,000 or to imprisonment for not more than one year, or to both such fine and imprisonment.
