Commission Comment: [Historical comments removed.] The full text of the Saipan Zoning Law, referred to in this section, was set out as an attachment to SLL 18-4 and has not been codified within the Commonwealth Code. For more information on the decision not to codify the Saipan Zoning Law, see 10 CMC § 3512 and the Commission comment thereto. In addition to severability and savings clauses, SLL 18-4 included the following Short Title and Findings and Purpose sections: Section 1. Short Title. This Act may be cited as the “Saipan Zoning Law of 2013.” Section 2. Findings and Purpose. The Saipan and Northern Islands Legislative Delegation (SNILD) finds that the Saipan Zoning Law of 2008 took effect on December 5, 2008. The Zoning Office is seeing improvements in different areas as follows: (a) Parking lots and road accesses are safer and more attractive;

(b) New buildings with landscaping are more attractive and pedestrian friendly; (c) Signs are more durable and interesting; (d) Auto Shops or poker parlors are being kept out of villages; (e) Neighborhoods, commercial and industrial developments are being separated; and (f) Subdivisions are being designed with streets that are wide enough for cars to pass and with turnaround areas for emergency vehicles. The SNILD further finds that despite the many improvements in zoning, the Zoning Board and Office, together with local businesses, zoning clients, and other agencies, have identified ways to improve the Saipan Zoning Law of 2008. The Zoning Office has submitted proposed amendments to the Saipan Zoning Law of 2008 in the form of the Saipan Zoning Law of 2013. These proposed amendments were developed in consultation with the public during eighteen (18) village meetings and public hearings, nine (9) public education sessions, and through press releases, newspaper announcements and comments received from members of the public. Some of the key amendments to the Saipan Zoning Law are as follows: Single Family Residences will be allowed in most of the zoning districts. Light retail, such as small “Mom and Pop” grocery stores, bookstores, flower shops and daycares have been permitted in Village Residential districts or allowed as conditional uses. The Zoning Board believes that these changes more accurately reflect the nature of residential living on Saipan than the requirements of the Saipan Zoning Law of 2008 and encourage more walkable neighborhoods. Apartment buildings less than forty-eight (48) feet in height will be permitted in Village Residential areas, while apartment buildings over forty-eight (48) feet in height and professional offices will be allowed as conditional uses. Small aquaculture projects that meet certain requirements would also be permitted. In residential neighborhoods, fence heights have been raised to ten (10) feet to allow for greater security for residents, provided that the fence is made of appropriate materials that do not detract from the appearance of the neighborhood. Certain industrial uses, including manufacturing, warehousing, and junkyards, have been confined to Industrial and Mixed Commercial districts and removed as permitted uses in Rural areas. A new category of use “Intensive Outdoor Amusement,” which would include uses such as race tracks and carnivals previously included in category of Outdoor Amusement has been created as a conditional use in Rural areas. Proposed revisions to the law prohibit using containers as fencing but allow for use as permanent storage when properly screen from public view. Cargo containers may be transformed into residential structures provided that when a cargo container is to be used as a residence, it shall be architecturally altered to reduce its industrialized appearance by providing windows and doors, and other features such as open porch areas. Requirements for Temporary Batch Plants for concrete and asphalt necessary for construction projects are spelled out in detail. Batch Plants may not be within one

If the temporary site is not within one hundred fifty (150) feet of a public use, the applicant may seek permission of all nearby persons with an interest in the surrounding properties to operate the Temporary Batch Plant within the setback area. Accordingly, the purpose of this legislation is to adopt the proposed amendments to the Saipan Zoning Law of 2008 by enacting this Saipan Zoning Law of 2013, which is incorporated and codified herein by reference, and by repealing Saipan Local Laws 16-6, 17-2, 17-10 and 17-12. Saipan Local Law 18-5 (enacted on Oct. 25, 2013) contained amendments to Articles 4, 6, and 12 of the Saipan Zoning Law of 2013 (SLL 18-4), dated July 15, 2013. SLL 18-5 also contained Severability and Savings Clause sections which have not been codified within the Commonwealth Code. Short Title, Findings, Purposes, and Amendment sections are as follows: Section 1. Short Title. This Act shall be known as the “Saipan Adult Gambling Machine Business Zoning Law of 2013.” Section 2. Findings. The Legislature finds that: (a) Adult gambling machine businesses pose a risk to neighborhoods and their residents because such businesses are a target for robberies and other crimes; (b) Gambling addiction is a problem that can cause severe financial and social problems for families on Saipan. The location of gambling machines in residential districts and near residential conveniences can increase the temptation to gamble and increase the likelihood that a person will gamble and develop an addiction; (c) Adult gambling machine businesses in residential districts, or in districts adjacent to schools, churches, or public recreational areas, or within close proximity to such uses, may expose minors to such businesses and the activities associated with such businesses. This exposure may adversely affect minors due to their immaturity; and (d) Special regulation of gambling businesses uses is necessary to ensure that such uses do not become permanent incompatible land uses and further, will not contribute to the blight or downgrading districts in which they are permitted, thereby adversely affecting property values and deterring or interfering with the development and operation of other businesses within the area. Section 3. Purposes. In order to provide our people with a healthy and safe social and business environment: (a) It is the purpose of Saipan Adult Gambling Machine Business Zoning Law of 2013 (hereinafter “Law”) to regulate adult gambling machine businesses to promote the health, safety, morals, and general welfare of the citizens of the Commonwealth, and to establish reasonable and uniform regulations to prevent the deleterious location and concentration of adult businesses and, in particular, to separate adult businesses from family-oriented uses.

(b) It is the purpose of this Law to improve the quality of life of Commonwealth citizens and to provide for the socially and commercially acceptable location of adult gambling machine businesses. (c) Based on the foregoing, the Legislature finds and declares that this Law is necessary and is a proper use of the legislative authority granted by Article II of the Commonwealth Constitution. Section 4. Amendment. Article 12 of the Saipan Zoning Law of 2013, SLL 18-04, is hereby amended by adding the following new Section 1210: “Section 1210. Nonconforming Adult Gambling Machine Businesses. “(a) Any legally established adult gambling machine business that is in a location in which such business would not be permitted as a new business under the Law shall be considered a nonconforming use. “(b) Within four years of the effective date of this Law, at the end of the last full renewal period of its license from the Department of Finance prior to the deadline, all nonconforming adult gambling machine businesses shall be located in the Adult Business Park, Tourist Resort, Mixed Commercial, Garapan Core, Garapan East, or Beach Road Zoning Districts, in accordance with Section 612(b), so long as the establishment is located 200 feet from any other adult gambling machine business, and any church, Laundromat, public and private school, park or playground. “(1) The Board may approve an extension of the deadline to allow for amortization of the business investment in property, leaseholds, or leasehold improvements. A request for extension shall be submitted in writing at least six months prior to the above date and shall be supported by such information as may be required by the Board. The Board may grant an extension upon finding the following: “(2) In order to obtain the extension, the burden shall be on the adult gambling machine business to show that it is lawfully established, is not a public nuisance and will be unable to recoup the value of the investment in an adult gambling machine business made after the effective date of this Law shall be considered for the purpose of an extension of the deadline. “(c) The Commonwealth Zoning Board may adopt regulations to implement the elimination of nonconforming adult gambling machine businesses in accordance with this Law.” Section 5. Amendment. Article 4 of the Saipan Zoning Law of 2013, SLL 18-04, is hereby amended by adding “P1” to Table 1 for Adult gambling machine business in Garapan Core, Garapan East, and Beach Road Districts. Section 6. Amendment. Article 6 of the Saipan Zoning Law of 2013, SLL 18-04, is hereby amended by amending Section 612(b) as follows [with drafting marks omitted]: “(b) Except in Garapan Core, Garapan East and Beach Road Districts, in any zoning district where an adult gambling machine business is permitted, it shall only be located: “(1) On a lot abutting Beach Road between Afetna Road and Chalan Msgr. Guerrero and on Chalan Pale Arnold between Chalan Msgr.

Guerrero and Commonwealth Drive (provided that a new adult gambling machine business shall not be established in any zoning district within 300 feet of a church, Laundromat, public private school, park, playground or other adult gambling machine business; or “(2) In a hotel with more than 20 rooms.” Saipan Local Law 18-13 (enacted Jan. 23, 2014) provides: This Act amends the Official Saipan Zoning Map, dated July 15, 2013 of the Saipan Zoning Law of 2013. SLL 20-21 § 2 amended section 612(b) as follows: (b) An adult gambling machine business shall only be located: (1) Within the Tourist Resort and Mixed Commercial districts on lots abutting or west of Beach Road and Chalan Tomas Sablan from Afetna Road to Chalan Msgr. Guerrero and on lots abutting or west of Chalan Pale Arnold from Chalan Msgr, Guerrero to Orchid St., as well as in the Garapn Core, Garapan East, and Beach Road zoning districts, if the business is located no less than 200 feet away from a church, laundromat, public or private school, park, playground, or other adult gambling machine business; or (2) In a hotel with more than 20 rooms if it is located within the Garapan Core, Garapan East, Beach Road, Tourist Resort or Mixed Commercial zoning districts; and (3) The restrictions on adult gambling businesses in sections (1) and (2) of this subsection shall not apply to the holder of a license issued by the Commonwealth Lottery Commission pursuant to Public Law 18-56. Saipan Local Law 21-6 (enacted July 26, 2019) contained two amendments to the Saipan Zoning Law of 2013 (SLL 18-4), dated July 15, 2013. SLL 216, §§ 4, 5 amended sections 612(b) and 1210(b) as follows: [Article 6, Section 612] (b) An adult gambling machine business shall only be located: Within the Tourist Resort and Mixed Commercial districts on lots abutting or west of Beach Road and Chalan Tomas Sablan from Afetna Road to Chalan Msgr. Guerrero and on lots abutting or west of Chalan Pale Arnold from Chalan Msgr. Guerrero to Orchid Street., as well as in the Garapan Core, Garapan East, and Beach Road zoning districts, if the business is located no less than 200 feet away from a church, laundromat, public or private school, park, or playground; or [Article 12, Section 1210] (b) Within four years of the effective date of this Law, at the end of the last full renewal period of its license from the Department of Finance prior to the deadline, all nonconforming adult gambling machine businesses shall be located in the Tourist Resort, Mixed Commercial, Garapan Core, Garapan East, or Beach Road Zoning Districts, in accordance with Section 612(b), so long as the establishment is located 200 feet from any church, laundromat, public or private school, daycare, park or playground. No restriction set forth in any other Article or Section of this law shall be construed to prevent two or more adult gambling machine businesses from operating out of the same building, unit, or establishment, provided that all other requirements of this law are met and complied with. Saipan Local Law 21-9 (enacted Sept. 18, 2019) contained two amendments to the Saipan Zoning Law of 2013 (SLL 18-4), dated July 15, 2013. SLL 21-9 also contained Findings and Purpose, Severability, and Savings Clause sections which have not been codified within the Commonwealth Code. The two amendments are as follows: Article 4, Section 404, Table 1, page 27, of the Saipan Zoning Law of 2013 incorporated by 10 CMC § 3511, is hereby amended as follows: “The use, ‘Hospital’ is to have a ‘C’ for conditional use in the column for ‘Village Commercial’.” Section 721. Hospital. When the applicant for a conditional use is a Hospital, the applicant shall meet in minimum standards of hospital certification regulations promulgated pursuant to Title XVIII of the Social Security Act and Title 42 CFR Section 1861, et. seq.; Health Insurance Portability and Accountability Act; and Emergency Medical Treatment and Active Labor Act. Saipan Local Law 21-11 (Dec. 19, 2019) contained an amendment to the Saipan Zoning Map originally appended to the Saipan Zoning Law of 2013. SLL 21-11 also contained Findings and Purpose, Severability, Savings Clause sections, and images of amended map sheet which have not been codified within the Commonwealth Code. Section 102; Section 103; Section 401; Section 404; Section 405; Section 406; Section 408; Section 410; Section 411; Section 412; Section 414; Section 415; Section 504; Section 506; Section 507; Section 508; Section 509; Section 1207; and Section 1210 of the Saipan Zoning Law of 2013, as amended, is hereby amended (along with the deletion of Sections 513 & 514 and the addition of a new Section 1211) pursuant to the attached exhibit A. Saipan Local Law 22-07 (Dec. 10, 2021) contained one amendment the Official Saipan Zoning Map Sheet 23 of 29, dated July 15, 2013, of the Saipan Zoning Law of 2013. SLL 22-07 also contained Findings and Purpose, Severability, and Savings Clause sections. The amendment provision is as follows: SECTION 2. AMENDMENT: “All properties abutting Isa Drive from the intersection of Kanat Tabla Drive to Dandan Road are hereby rezoned as ‘Mix Commercial’ zoning districts.” Saipan Local Law 22-11 (June 22, 2022) contained one amendment of Table 1, under Section 404, of the Saipan Zoning Law of 2013. DIVISION 3: THIRD SENATORIAL DISTRICT (SAIPAN, ETC.) contained Findings and Purpose, Severability, and Savings Clause sections. The amendment provision is as follows: SECTION 2. AMENDMENT: “Auto Rental office with storage, staging and service on site shall be allowed for conditional use in ‘Village Commercial’ zoning districts.” Saipan Local Law 24-06 (July 29, 2025) contained one amendment to Article 4, Section 410 of the Saipan Zoning Law to add a new subsection (k) to read as follows: “(k) Automobile Sales & Service. An establishment engaged in the marketing, direct or indirect sales, and servicing of new and used automobiles, including light trucks and motorcylces. Typical activities include vehicle sales, manufacturer recall work, diagnostics, maintenance (e.g., tune-ups and oils changes), mechanicals repairs, parts replacement, paint work, body work, glass work, washing, detailing, and warranty repair work. Automobile Sales & Service businesses may also include sales lots, showrooms, and repair and service centers.”
