§ 3802. Law Revision Commission: Composition. (a) The commission shall be composed of the following members: (1) The Chief Justice of the Commonwealth Supreme Court, or either an Associate Justice or Superior Court Judge designated by the Chief Justice, who shall preside as chair of the commission; (2) The chair of the Commonwealth Legislature Senate Committee on Judiciary, Government and Law, or a member of the committee designated by the chair of that committee; (3) The chair of the Commonwealth Legislature House of Representatives Committee on Judiciary and Governmental Operations, or a member of the committee designated by the chair of that committee; (4) The Attorney General of the Commonwealth or an assistant attorney general designated by the Attorney General; and (5) One member of the Northern Mariana Islands Bar Association elected by the membership thereof. (b) The commission is exempt from the provisions of 1 CMC § 2901(g). (c) In the absence of the Chief Justice, or his designee under subsection (a) of this section, the most senior Associate Justice of the Supreme Court shall serve as the chairperson. (d) Members of the commission shall serve without pay, but shall be reimbursed for reasonable and necessary expenses incurred in connection with performance of official duties and functions. The commission shall establish procedures for reimbursement of members who have incurred such expenses. Source: PL 8-22, § 3 (§ 3802); (c) amended by PL 14-24, § 2. Commission Comment: PL 14-25 was enacted on July 30, 2004. In addition to severability and savings clause provisions, PL 14-25 contained the following finding: Section 1. Finding. The Legislature finds that the next most senior available Justice of the Supreme Court of the Commonwealth of the Northern Mariana Islands should sit in place of the Chief Justice, or his designee, as chairperson of the Commission in his absence.
