§ 3805. Executive Director: Appointment; Duties. (a) The chair of the commission shall, with commission approval, appoint an executive director qualified by training and experience to perform the duties set forth in this section. The executive director shall be exempt from the civil service. (b) The executive director shall, in consultation with the commission: (1) Periodically revise and publish the Commonwealth Code, codifying new laws of a permanent nature and incorporating revisions of existing statutes; (2) Periodically publish decisions rendered by Commonwealth courts that have value as precedent, and maintain the Commonwealth case reporter system of headnoting within specified topics; (3) Periodically revise and publish a Commonwealth digest of headnotes from published decisions rendered by Commonwealth courts; and (4) Provide research, analysis and drafting services to the commission to assist it in formulating proposed legislation. (c) The executive director may, with commission approval, hire such professional, clerical and other staff as may be deemed necessary to assist the commission in performing its duties and functions. All personnel hired under this subsection shall be exempt from the civil service and shall be employed according to the terms of contracts entered between the commission and the employee or independent contractor. The commission may not enter into an employment contract in the absence of a budgetary appropriation authorizing expenditure of commission funds for that purpose. Source: PL 8-22, § 3 (§ 3805).
