Standard of Care. Diagnosis, treatment, and consultation recommendations, including discussions regarding the risk and benefits of the patient's treatment options, made by telehealth are held to the same standard of care or practice standards as are applicable to in-person mental and/or behavioral health services settings. If mental and/or behavioral health services by telehealth are not consistent with this standard of care, the services provider must direct the patient to seek in-person care.
