§ 4137. Penalties. Any person who violates the provisions of 2 CMC § 4133 or any rules or regulations promulgated pursuant to 2 CMC § 4134, is subject to a civil fine not to exceed $5,000 for each violation. Any person who violates the provisions of 2 CMC § 4135, shall be subject to a civil penalty of $250 per day, but not less than $150 per day. In addition to civil fines provided by this article, any person who violates the provisions of this article shall be denied a permit until such person complies with the provisions of this article. Further, any person who has cut or trenched into a road within 12 months before September 28, 1987, as a condition to obtaining a permit, such person shall comply with the provisions of 2 CMC § 4135.
