§ 4464. Marketability of Title. Title to a permanent and long-term interest in real property in the Commonwealth shall not be considered unmarketable merely because of the restriction on alienation of permanent and long-term interests in real property contained in N.M.I. Const. art. XII, § 2. Persons providing title insurance or other forms of title assurance may cite this chapter as authority for insuring or otherwise assuring that, despite such cited constitutional restriction, the title to a permanent and long-term interest in real property is marketable.
