Right to Possession

Right to Possession. The mortgagee is not entitled to possession of mortgaged property unless the mortgage expressly grants a right of possession. However, after the execution of the mortgage, the mortgagor may agree to deliver possession to the mortgagee without additional consideration. Source: DL 4-143, § 4.
