§ 4913. Interests in Real Property: Recording and Certification. (a) Any conveyance or other transfer of real property required to be in writing by 2 CMC § 4912 shall be recorded with the Commonwealth Trial Court Recorder’s Office by the party receiving the interest or estate. In the event that the writing required by 2 CMC § 4912 fails to disclose the underlying amount and terms of payment, if any, the receiving party shall file sufficient documentation to disclose such facts. (b) Upon compliance with such rules as to form, copies, and fees, as the Commonwealth Trial Court may reasonably establish, or as may be required in law, the court shall provide copies certified as recorded to any person upon request. Commission Comment: Section 4 of PL 6-25, the “Commonwealth Judicial Reorganization Act of 1989,” provides that “[w]herever the term ‘Commonwealth Trial Court’ appears in the Commonwealth Code, it is henceforth to be interpreted and understood to refer to the Commonwealth Superior Court.”
