Complaints and Actions in Labor Matters. (a) Individual complaints. Any foreign national worker who is aggrieved by the failure or refusal of his or her employer to comply with an approved employment contract may make a complaint to the Department. Any employer of a foreign national worker who is aggrieved by the failure or refusal of his or her employee to comply with an approved employment contract may make a complaint to the Department. (b) Department actions. The Department may commence an action against an employer or a foreign national worker for an alleged violation of the labor or wage laws of the Commonwealth. (c) Court actions. The Attorney General, at the request of the Secretary, may institute an action in any court of competent jurisdiction for a temporary restraining order, injunction, or other appropriate remedy to enforce any provision of this chapter.
