§ 4949. Judicial Review. (a) Judicial review of a final action of the Secretary is authorized after exhaustion of all administrative remedies and shall be initiated within thirty days of final action. (b) Except as may be contrary to the provisions of this chapter, judicial review shall be pursuant to 1 CMC § 9112. Appeal from a final action by the Secretary shall be directly to the Commonwealth Superior Court. (c) Notwithstanding any other provision of law: (1) Notice of all actions and proceedings pursuant to this section shall be served upon the Attorney General; (2) Judicial review shall be confined to the record; and (3) Actions involving judicial review of final action by the Secretary shall be limited to the appeal; other causes of action may not be alleged in the action for judicial review.
