§ 50213. Procedure for Suspension, Revocation or Failure to Issue a Certificate of Compliance. No recommendation for suspension or revocation of a Qualifying Certificate or failure to issue a Certificate of Compliance shall be made by the Commonwealth Economic Development Authority Board without a notice to the Beneficiary and a hearing in accordance with the provisions of the Administrative Procedure Act, 1 CMC §§ 9101 et seq. For the purposes of the Administrative Procedure Act, a Qualifying Certificate shall be deemed a “license” and the recommendation of the Board shall be deemed an “agency action” subject to direct judicial review pursuant to 1 CMC § 9112.
