§ 5103. Mayor: Vacancy in Office. (a) If a vacancy should arise in any office of the mayor, and less than half of the term of the mayor remains, the Governor shall fill the vacancy by appointing the unsuccessful candidate for that mayor’s office from the previous election, who received the largest number of votes and is now still willing to serve as mayor of that island or islands. (b) If no candidate is available, or if no candidates wish to serve as mayor, the Governor shall appoint a person qualified for the office from the island or islands involved. (c) Any appointment made pursuant to this section shall be only for the remainder of the term of the mayor being replaced. Source: PL 4-23, § 2. Commission Comment: See N.M.I. Const. art.
