§ 5106. Mayor: Constitutional Duties. A mayor shall have the power and duty to: (a) Serve on the Governor’s council established by the Commonwealth Constitution to advise the Governor on local matters. (b) Review the government services and appropriations provided by law for the island or islands served by the mayor and shall submit to the Governor findings or recommendations relating to these services or appropriations. (c) Investigate complaints and conduct public hearings with respect to local matters and may submit findings or recommendations to the Governor. (d) Recommend items for inclusion in the proposed annual budget, review the proposed budget before its submission by the Governor to the legislature, and recommend amendments in the proposed budget relating to the island or islands served by the mayor. (e) Promulgate regulations on local matters as provided by law. (f) Expend for local public purposes the revenues raised by local taxes that are designated by law for those purposes after the expenditures are authorized by the legislature or by the affirmative vote of a majority of the members of the legislature representing the island or islands served by a mayor. (g) To issue marriage licenses pursuant to 8 CMC § 1202 and to perform marriage ceremonies. (h) Appoint, supervise and remove those employees as are provided by law to assist in the performance of mayoral responsibilities. (i) [Removed.] Source: N.M.I. Const. art. See also N.M.I. Const. art. VI, § 5 (concerning the Governor’s Council), and art. III, § 17 (concerning public services). The Commission removed subsection (i) pursuant to PL 3-90 § 10. This subsection was enacted as part of PL 5-31, an appropriation law, and was not expressly intended to become a permanent portion of the code.
