§ 51539. Occupant’s Declaration of Opposition to Sale. The occupant may prevent a sale of the personal property to satisfy the lien if he executes a declaration of opposition to the sale under penalty of perjury and returns the declaration to the owner by certified mail. The declaration must contain the following: (a) The name, address and signature of the occupant; (b) The location of the personal property which is to be sold to satisfy a lien; (c) The date the declaration was executed by the occupant; and (d) A statement that: (1) The occupant has received the notice of the sale to satisfy the lien; (2) He opposes the sale of the property; and (3) He understands that the owner may commence an action for the amount of the lien and the costs of the action.
