§ 5206. Civil Defense: Immunity From Suit. The Commonwealth government is not liable for any damage to property or for any death or personal injury occurring directly or indirectly as a result of the exercise or performance of, or failure to exercise or perform, any function or duty, by any Commonwealth agency or employee, in carrying out the provisions of this chapter during the period of any civil defense emergency. Nothing in this section shall affect the right of any person to receive any benefit or compensation to which he or she might otherwise be entitled under any contract of employment, worker’s compensation law or any other law providing for any pension, retirement, accident or health insurance.
