§ 5607. Scuba Diving Tour Operation License. (a) In order to obtain a business license for a scuba diving tour operation, a business must employ one or more persons qualified to serve as tour leaders. (b) Each tour leader must possess: (1) A certificate evidencing that he or she is currently certified at the level of instructor, assistant instructor, or dive master, except where the standards of the certifying organization do not permit such a level of certification to guide scuba divers underwater; and (2) A liability insurance policy sufficient to insure that tour leader and the business against the accidental death or accidental injury of any customer which may occur during a scuba diving tour, in the amount of $500,000 per incident. (c) No business license shall be issued or renewed for scuba diving tour operation unless the applicant presents evidence of compliance with subsection (b) of this section for each tour leader employed by the business. (d) No person shall act as a scuba diving tour leader until the business presents evidence of that person’s compliance with subsection (b) of this section to the Department of Finance. (e) A person may qualify to serve a business both as an instructor and as a tour leader. Source: PL 7-47, § 5 (§ 5606); subsection (d) amended by PL 16-6 § 3(c)(1).
