§ 5654. Presentation of Identification and Evidence of Issuance of Placard to Peace Officer Upon Request. (a) Any person using a special identification placard issued pursuant to 9 CMC § 5653 for parking as permitted by that section shall, upon request of any peace officer or person authorized to a enforce Commonwealth or local parking laws or regulations, present identification and evidence of the issuance of that card to that person. (b) Failure to present the requested identification and evidence of the issuance of that placard shall create a rebuttable presumption that the placard is being misused and that the associated vehicle is or has been parked in violation of the provisions of this article. (c) In addition to any other applicable penalty for the misuse of a placard, the officer or parking enforcement officer may confiscate a placard being used for parking purposes that would benefit any person other than the person to whom the placard was issued by the Bureau of Motor Vehicles. (d) Notwithstanding subsection (c) of this section, it shall not be a violation of this article to use the placard for parking purposes in the course of lawfully transporting or accompanying the disabled person to whom the placard is issued, nor shall a placard lawfully so used be confiscated.
