TITLE 9: VEHICLE CODE DIVISION 5: RULES OF THE ROAD

§ 5660. Citation; Penalties; Registered Owner and Driver Both Responsible. (a) It is unlawful for any person to park or cause a vehicle to be parked in a parking space reserved for the use of persons with disabilities. If a parking space requires both a sign and paint, but is not equipped with both sign and paint, then a finding of guilt may still be rendered under this section if the parking space was marked with a sign or paint. (b) Unattended vehicles parked in violation of the provisions of this article shall be cited in accordance with the provisions of 9 CMC §§ 1311 and 1312. (c) The presumption stated at 9 CMC § 5604 shall apply with equal force to the registered owner of a vehicle parked in violation of the provisions of this article, except that if the actual driver of the unlawfully parked vehicle is known to the citing officer then the driver shall be jointly and severally responsible with the registered owner for the violation, except in a case in which holding the registered owner jointly responsible would not be in the interests of justice. (d) The penalty for parking in violation of this article shall be $150 for the first violation. For the second violation the penalty shall be a $300.00 fine. For all subsequent violations, a fine of no less than $300.00 and no more than $1,000.00. (e) In addition to the penalty set forth herein for parking in violation of this article, the registered owner of a vehicle parked in violation of the provisions of this article shall be liable for all towing and storage charges incurred in removing and storing the illegally-parked vehicle, and all such charges must be paid and satisfied before any such vehicle is released to the custody of its registered owner. (f) A person who uses a special identification placard in violation of the provisions of 9 CMC § 5654(c) shall be guilty of a misdemeanor, with the same penalty set forth in 9 CMC § 5660(d) for parking in violation of the provisions of this article. (g) Special Accounts: Funds realized under subsection (d) of this section shall be distributed as follows: (1) The Secretary of Finance shall establish as special account for the Department of Public Safety. Twenty-five percent of the fines collected pursuant to 9 CMC § 5660(d) shall be deposited into this special account. The expenditure authority shall be the Commissioner of Public Safety. Funds deposited into this account shall be used for the Celebration of the Annual Police Week, honoring fallen police officers and firefighters. (2) The Secretary of Finance shall establish a special account for the Northern Marianas Protection & Advocacy Systems, Inc., (NMPASI). Twenty-five percent of the fines collected pursuant to 9 CMC § 5660(d) shall be deposited into this special account. The expenditure authority shall be the Executive Director of NMPASI. Funds deposited into this account shall be used solely for public education and outreach.
