2 CMC § 5801

TITLE 2: NATURAL RESOURCES

DIVISION 5: ANIMALS, PLANTS AND FOOD

§ 5801. Captive/Domesticated Sambar Deer (Binado). It is hereby legal in the Commonwealth to capture alive Sambar Deer (Binado) during authorized hunting season as provided by regulation. Source: PL 17-23 § 3 (October 19, 2010), modified. Commission Comment: The Commission changed “authorize” to “authorized” pursuant to 1 CMC § 3806(g) This is exactly as stated in Public Law 1723. PL 17-23 (enacted on October 19, 2010) included severability and savings clause provisions and the following: Section 1. Short Title. This act may be cited as "The Raising of Sambar Deer in Captivity Act of 2010." Section 2. Findings and Purpose. The Commonwealth Legislature finds that hunting of Sambar Deer is seasonal as established by regulation to control their continued existence and to prevent its extinction. The Commonwealth Legislature further finds that there are several people in the CNMI who are presently raising Sambar Deer in captivity and many have express [sic] similar interest if the law or regulation would allow them. It is the purpose of this Act to legalize or allow the raising of Sambar Deer in captivity.
