§ 6920. Persons Under Criminal Prosecution in the Commonwealth at Time of Requisition. If a criminal prosecution has been instituted under the laws of the Commonwealth against a person subject to extradition and is still pending, the Governor, in the exercise of discretion, may either surrender the accused on the demand of the executive authority of another state or may hold the accused until he or she has been tried and discharged or convicted and punished in the Commonwealth.
