Enforcement. (a) The Insurance Commissioner may cause to be prosecuted an action in any court of competent jurisdiction to enforce any order made by the commissioner pursuant to any provision of this division. (b) If the commissioner has cause to believe that any person has violated any penal provision of this division or of any other laws relating to insurance, the commissioner shall certify the facts of the violation to the Attorney General. (c) If the commissioner has cause to believe that any person is violating or is about to violate any provision of this division or any order of the commissioner, the commissioner may bring an action in any court of competent jurisdiction to enjoin the person from continuing the violation or doing any act in furtherance thereof. (d) The Attorney General shall prosecute or defend all proceedings brought pursuant to this division when requested by the commissioner. Source: PL 3-107, § 7, modified.
