§ 7114. Authority to Modify the Code. Commission Comment: [Historical comments removed.] In addition to severability and savings clause provisions, PL 21-14 included the following Findings and Purpose, Public Notice, and Effective Date sections: Section 1. Findings and Purpose. The Legislature finds that, nationally, building codes are updated in three (3) year cycles. The Commonwealth of the Northern Mariana Islands is currently using a version of the building code that is based on the 2009 International Conference of Building Officials (ICBO), as adopted by regulation. The Legislature finds it is critical for the proper development of local infrastructure to ensure the building code remains up to date with national standards. It is the intent of the Legislature, therefore, to adopt the International Building Code as the official building code of the Commonwealth of the Northern Mariana Islands, to make the 2018 edition the current version applied in the Commonwealth and to direct the Building Safety Official to adopt relevant appendices, and updates to, or new editions of this Code, and exclude non-applicable sections, as needed. Section 5. Public Notice to be Given. Following enactment into law of this Act, the Building Safety Division is hereby directed to publish in a newspaper of general circulation the adoption and effective date of the International Building Code as the new building code of the Commonwealth of the Northern Mariana Islands, and to post, in conspicuous locations within its premises, notice of the same. This publication and posting shall take place no later than thirty (30) days after enactment. Section 8. Effective Date. This Act shall take effect 180 days after its approval by the Governor or becoming law without such approval. Prior to its repeal, this section read as follows: Whenever there are practical difficulties involved in carrying out the provisions of this code, the building safety official, at the request of the permit applicant, shall recommend to the Building Safety Code Review Board a grant of modification for the permit applicant’s individual case, provided the building safety official shall first find that a special individual reason makes conformity to the strict letter of this code impractical, and that the modification is in conformity with the intent and purpose of this code and that such modification does not lessen any fire or flood protection requirements or will not detrimentally affect the structural integrity designed to be achieved by the provisions of this code or of any regulation adopted under the authority of this code.
